(Long Story)who is to blame(texas car accident)?

I was driving on the lane next to the exit ramp lane. I checked if any one was in the exit ramp lane and no one was in it only a car behind me. so I turn my signal light on and start to turn and when I am almost completely in the exit ramp my mother and my brother yell "watch out" and out of the corner of my eye I see a car coming from behind and speeding pass me from the right side and he managed to hit me on my right front panel just infront of the tire. he must of thought he had passed me and turn left to get back into the lane. When we parked our cars we met each other and he said " I am sorry bro I saw you but I thought I could make it" but then when the cops came he changed his story. He says that he had turned to the exit ramp and passed me then I turned then hit him. Think about this if he was in back of me, how in the world was he able the pass me with out speeding because the speed limit of the main lane is 60mph and the exit ramps is 50mph. I was going about 58-60mph before turning to the exit ramp so if he says he had passed me how can he explain appearing in front of me with out speeding remember he was in back of me and if he turned to the exit ramp he had to have started to reduce his speed. Still the cops gave me a ticket for an unsafe lane change and he gave the other driver a ticket for not having a license and it was not suspended or expired nor revoked he just had never taken the test before. I want to add for your better understandment that my car was insured but I was not covered by it. and he also did not have insurance. I also understand how it appeard to the police they did not see the crash so when they arrived all they saw was where the damage was and said that I was at fault. given what I just explained do I have a reasonable case to fight? The other driver either saw my signal but thought he could make it or was not paying attention and managed to get away with it becuase he had spead up and he managed to hit me from the front side yet LOOKED like I hit him.

Texas Car Accident quest ?

First off i have never been in anything more than a fender bender . On sat aft i was struck by a Tour bus switching lanes , Trashed the entire pass side of my car had to chase the guy down didnt even know he hit me . Police worked it he got two tickets i was able to limp home . woke sun morn neck pain waited till monday to see if would go away went and saw a random doctor from my hmo no big problems on my neck . The insurance Company is national interstate insuarnce i made a claim spoke with somebody that i could barely understand and got nothing . Now since i was bruised and banged in the car accident shouldnt they rembruish me for my doctor visit ? and cover the cost of my damages to my car ? Should i try toi handle this myself or get a lawyer ?

You will probably need an attorney since they are stonewalling you, any medical cost incurred would be covered by the insurance company and you may have to sue t get them to do it.~

A friend had a car accident and presented the police with invalid insurance, what is the penalty in Texas?

A freind of mine was in a car accident. She wanted to avoid a no insurance ticket, so she presented a copy of an insurance card, the dates were vaild, but the insurance is not in effect due to non-payment. The person she was in the accident with attempted to file on her insurance and of course was told she was not covered during the time of the accident. His attorney has contact local police to inform them of her discression, does anyone know the penalty for presenting the police with invalid insurance in the state of Texas?

Can your friend just say "oh crap, I forgot to pay the premium" to get their insurance valid again? Maybe your friend can use the defense that they didn’t know that it was invalid?

What are the hit and run car accident laws in Texas?

So my friend had a party and she got drunk. She had her friend drive her and her friends home because they were drunk. He ended up hiting someone pulled over and then just drove off. The other driver called the cops and identified the guy as the driver. The cops called my friends parents because the truck is in her moms name. The cops now want her to go to the courthouse with her truck her license and the insurance but the thing is she has warrants for prvious tickets. What should she do?

She has two choices: Or she take responsibility for the tickets, OR she goes to jail for the hit & run…plus paying for the tickets anyway.

She must go to court period, running away or hiding would be very stupid, and the police would assume she was the one driving. And even if police know she was not driving she would be charged for helping the driver.

Texas accident a stolen car damages a fence so who is resposible?

I live in Texas and a neighbors vehicle is stolen and the reported thief wrecks into my metal pipe fence causing estimated $1500 in property damages. The thief flees the scene an is never caught. I file for property damage and claim is denied due to being a non permissive driver. Should then there not be a theft of auto report to attached at some point , maybe a reference number? There is no mention of it in the accident report at all?
Highway Patrol responded and wrote the accident report said to call the County Sheriffs Office to see if there was a theft report made saying they do not handle the criminal side (???beats me)
No theft report. I guess its up to the owner to report or not. Seems with the owner claiming no one given permission to drive & whether stolen or not, I am stuck with the damages. I have no home owners either.
One last thing which makes no difference i suppose but here goes. The thief(if one) steals a extend cab p/u from a well lit driveway at 1:31 a.m. as the owner states in accident report . Speeding down a 100 foot gravel driveway headed West and failing to control his speed goes straight across the roadway between two mail boxes into a maybe 20 foot wide ditch. The driver then over corrects(a 14 foot truck in a 20 foot ditch) sending him headed after a full 180 deg. directly back East and into a 25 foot ditch and coming to a dead stop in my fence. driver flees and escapes unidentified.

As an insurance adjuster I have handled many claims like this (including Texas in the early 90’s). I have never worked for an insurance company where we were allowed to deny a claim based on theft without having a valid theft report on file with the Police Dept. If there is no official theft report then I would dispute the denial. A denial of payment to you is legit if there is a police theft report on file. In some cities the theft report is separate from the accident report. Since your property was damaged you should have the right to know if there was a theft report filed. If you haven’t already done so call the local police and ask them.
