Who is liable when a car crashes into my back corner?

After pulling out of a service station into the far lane, a car has crashed into my drivers side rear corner. I am sure I had enough time to pull out, and the driver admitted to thinking I wasn’t pulling into his lane. Although I wasn’t completely in the lane, the majority of my car was in the lane when the incident occurred. Am I responsible for the crash?

Usually when you’re hit from behind, it is the other driver’s fault. That being said, it was your duty to actually make sure that you had enough clearance and time before pulling into the other lane. I’m pretty sure the insurance company will deem you at least partially liable. Good luck!

I know that in the state of michigan, if you rear end someone, its your fault. You should always have control over your vehicle, and if you are unable to stop in time, than you are at fault. So it sounds like its the other guys fault, not yours :) He ran into you.

You are completely at fault. When entering a multi-lane roadway from a private drive the driver is required to yield right-of-way to all existing traffic on the public roadway. He is then to enter the roadway into the rightmost (for a right turn) or the leftmost (for a left turn) lane.

You pulled across multiple lanes. The other driver stated he didn’t expect you to pull into his lane; that expectation is based on the law saying that you can’t do a multiple lane change like that.

IOW, you pulled in front of him.

90% OF THE TIME THE PERSON THAT IS HIT FROM BEHIND IS NOT AT FAULT BUT YOU PULLED OUT INTO TRAFFIC SO THIS WOULD BE YOUR FAULT.

YOU STATED THAT YOU WERE SURE THAT YOU HAD ENOUGH TIME AND WELL THAT IS THE PROBLEM, YOU DID NOT NOT.

    GOOD LUCK.
