it depends on the extent of your injuries and the damage to your vehicle. if the injuries are great, and life altering then you might want an attorney. like broken bones, overnight hospitization, surgeries, etc.

if the vehicle is totaled, then you might want to consider an attorney.

also, if there is any doubt to who is at fault, like if the other party did NOT get a citation, but you feel they were at fault or you have witnesses they were at fault, but no police report to support that claim then you might want an attorney.

if it a clear cut case and they admit they were at fault and were cited, then you CAN do it without an attorney, but you need to put your negotiator hat on to do so..

keep track of everything. if you have back or neck issues go to a chiropractor and a doctor, do both. let them know you had an accident and you were not at fault and typically they will treat you up front.

secondly, keep receipts of everything you buy to treat yourself and/or be treated by either doc or chiropractor like prescriptions etc. if you have medical insurance, even if it pays for your treatments, the insurance company is still liable to you for the FULL amount of the bills. Don’t let them know that your health insurance is paying, it is none of their business.

continue treatment until you feel you are fully recovered, have full range of motion, no pain on a daily basis.

then, calculate everything (ad all receipts, medical bills, lost wages, pain and suffering from the accident, like missed fun or anything in which the accident affected your life, etc.) and take that times either 3, 4 or 5 depending on how bad the accident was. if it was minor then prepare to get 3 times the total you have calculated in medical, medicines, doctor bills, etc. etc.

this will be your beginning negotiating point.

As an auto liability claims adjuster, I tell you it makes no difference if you are represented by an atty or not. For me I prefer for you to be atty repd as the attorneys understand the laws as I do and they are typically easier to talk with. Having an atty, you will likely not get any additional money (and if you do it will likely be less then the cost of the atty). You also will not receive your money any faster. As soon as we receive all the peperwork we need, we will issue you a check for that with which we are responsible for, It makes no difference if you have an atty or not.

MY ANSWER TO YOUR QUESTION IS SIMPLY THIS THE REASON AND ATTONERY IS GOOD TO HAVE DURING A SITUATION LIKE THIS IS THAT WE AS PEOPLE DON'T REALLY ALWAYS KNOW ALL THE LAWS THAT ARE OUT THERE TO KNOW AND INSURANCE COMPAINES SAME WAY AS ATTONERYS DO!!! THEY ALSO KNOW THERE NUMBER ONE RULE IS WHENEVER POSSIBLE SCREW THE PERSON AND GIVE THEM NOTHING NO MATTER HOW HORRIFIC THA ACCIDENT! UNFORTUNATLEY THE COURTS ARE BOGGLED OVER WITH CLAIMS SO IT DOES TAKE ALONG TIME TO GET YOUR CLAIM HEARD IT'S LIKE YOUR ON A WAITING LIST UNDERNEATH PROBABLY BILLIONS OF PEOPLE ATTEMPTING TO GET MONEY SOME WITH VALID CLAIMS MOST WITHOUT VALID CLAIMS! Don’t get an attorney and go ahead and get as much money as you can out of the insurance company for loss of wages, medical, and your car. An attorney will take to much money!

I was in a car accident in December and my car was totaled. I just purchased the car two months before…from the insurance company I received 2thousand more than I paid for the car plus $10,000 for medical and loss of wages. I went to the hospital but didn’t have to stay overnight any. I did some physical therapy also. Also I received my check for my car a week after the accident and the 10,000 check in Feb….it tok a little time but it was worth it.

I couldn't disagree with you any more than I do. You haven't found the right one yet. They not only get you what you rightfully deserve, but they handle all the paperwork and headaches. It can be frustrating having to wait, but it can't be done overnight. Keep searching for a good attorney. Good luck!
